PROHIBITION OF TREATMENTS TO MODIFY SEXUAL CHARASTERISTICS OR

ANATOMY OF MINORS

Section 1. Prohibition on medical treatment to modify sexual characteristics or anatomy of a minor.
(1) As used in this section:
(a) “Medical treatment to modify sexual characteristics or anatomy” means a practice or treatment that:
(i) suppresses the development of endogenous secondary sex characteristics through surgery, hormones or other methods; or
(ii) modifies a patient’s sexual anatomy or endogenous secondary sex characteristics through surgery, hormones or other methods.
(2) A mental health professional, health care provider or parent may not provide or refer for medical treatment to modify sexual characteristics or anatomy to a person who is younger than 18 years old.
(3) Subsection 2 does not apply:
(i) where an individual’s sex cannot be determined at or before birth as male or female based upon externally observable genital anatomy, and
(ii) as a result of physical or physiological evidence observed later in the individual’s life, surgery is required to make the individual’s physical appearance congruent with the sex that would have been identified but for a disorder of sexual development at birth.
